Trump recently <a href=\"https:\/\/singjupost.com\/transcript-president-trump-elon-musk-speak-after-doge-order-signing\/?singlepage=1\" target=\"_blank\">said<\/a>, \u201cI always abide by the courts, always abide by them, and will appeal.\u201d<\/p>\n<p>Trump initially had the right constitutional interpretations, and the plaintiffs and judges had the wrong constitutional interpretations. Trump\u2019s response was the wrong constitutional interpretation.<\/p>\n<p>To know what\u2019s the right constitutional interpretation, it will help to go back to America\u2019s precursors to understand what really makes America great.<\/p>\n<p><strong>Selection by Customers <\/strong><\/p>\n<p>In the <a href=\"https:\/\/econjwatch.org\/File+download\/1279\/VanDeHaarSept2023.pdf?mimetype=pdf\" target=\"_blank\">Dutch Republic<\/a>, people benefited from <a href=\"https:\/\/pure.uva.nl\/ws\/files\/4296021\/61245_Lesger_Amsterdam_information2.pdf\" target=\"_blank\">printed<\/a> Bibles in common languages, individuated churches, and individual <a href=\"https:\/\/archive.org\/details\/religiouschoicei00poll\/mode\/2up\" target=\"_blank\">faith<\/a>. People gained Salamancan theologians\u2019 understanding that <a href=\"https:\/\/mises.org\/mises-daily\/world-salamanca\" target=\"_blank\">profit isn\u2019t evil<\/a>, picked up some of the Sephardi Jewish refugees\u2019 skills in <a href=\"https:\/\/www.aei.org\/articles\/jewish-genius\/\" target=\"_blank\">commerce<\/a>, and practiced value-adding <a href=\"https:\/\/books.google.com\/books?hl=en&#038;lr=&#038;id=nQkoEAAAQBAJ&#038;oi=fnd&#038;pg=PA156&#038;ots=iLBHCTr4L2&#038;sig=Wznn5fCEKcspL12CczWP0pMZPCk#v=onepage&#038;q&#038;f=false\" target=\"_blank\">cooperation and competition<\/a>.<\/p>\n<p>In England, people got further practice in commerce and law. Also, people became further repulsed by a government church, <a href=\"https:\/\/rconstitution.us\/on-the-reading-of-old-constitutions\/\" target=\"_blank\">absolute government power<\/a>, and restrictions on property rights.<\/p>\n<p>In the American Colonies, people earned freedom. Under the world\u2019s lowest total taxes of just 1% to 2% of GDP, Americans\u2019 purchasing power per person rose steeply to surpass the English people\u2019s by <a href=\"https:\/\/jamesanthony.us\/party-preview\/\" target=\"_blank\">68%<\/a>.<\/p>\n<p>People\u2019s <a href=\"https:\/\/www.heritage.org\/constitution\/#!\/articles\/0\/essays\/1\/preamble\" target=\"_blank\">general welfare<\/a> proved to be best promoted by freedom. Producers competed for customers, customers selected for the best value, and producers <a href=\"https:\/\/rconstitution.us\/the-forgotten-customers\/\" target=\"_blank\">delivered<\/a>.<\/p>\n<p><strong>Selection by Voters<\/strong><\/p>\n<p>Americans appreciated that similar competition and selection could also limit governments. Government people could compete for voters, voters could select for people who would severely limit governments, and some people could deliver.<\/p>\n<p>Some producers get outclassed by others, so some government people could similarly get outclassed by others. Although they wouldn\u2019t fail immediately, just like producers don\u2019t, they could fail soon enough; and peacefully, without revolution or war.<br \/>\nGovernment people\u2019s competition would certainly extend to interpretation of the supreme law, the Constitution.<\/p>\n<p>On every question of constitutional interpretation, one interpretation would prove to be right:<\/p>\n<ul>\n<li>Government officials whose interpretation wouldn\u2019t limit governments enough would get the upper hand for a while, but people\u2019s general welfare would then weaken. Voters would give such officials the boot soon enough.<\/li>\n<li>Government officials whose interpretation would limit governments more would gain the upper hand, and people\u2019s general welfare would then strengthen. Voters would keep electing such officials.<\/li>\n<\/ul>\n<p><strong>Exhausting All Alternatives<\/strong><\/p>\n<p>From the start, even the people who developed this constitutional approach and <a href=\"https:\/\/1drv.ms\/b\/s!An3D-l3nOEaanJljmXUdiGn8l5EdgA?e=J9Kjnq\" target=\"_blank\">sold it<\/a> to the <a href=\"https:\/\/jamesanthony.us\/party-preview\/\" target=\"_blank\">general public<\/a> then turned around and <a href=\"https:\/\/quoteinvestigator.com\/2012\/11\/11\/exhaust-alternatives\/\" target=\"_blank\">did everything but make it work<\/a>. From George Washington\u2019s first presidency onward, government people nearly always didn\u2019t use their powers against others to <a href=\"https:\/\/freethepeople.org\/self-limited-governments\/\" target=\"_blank\">limit them<\/a>.<\/p>\n<p>Voters did do <a href=\"https:\/\/jamesanthony.us\/wp-content\/uploads\/masters\/overview-james-anthony.pdf#page=7\" target=\"_blank\">their jobs<\/a>, though. Each party that offered smaller governments got voted into majority control. Once there, its people didn\u2019t limit others or limited others only very infrequently, but its people did limit themselves for a time, until they soon enough <a href=\"https:\/\/amgreatness.com\/2021\/04\/05\/a-new-major-party-is-forming-right-before-our-eyes\/\" target=\"_blank\">broke bad<\/a>. The USA still had at least one smaller-government major party all the way up to <a href=\"https:\/\/cdn.mises.org\/The%20Progressive%20Era_0.pdf#page=163\" target=\"_blank\">1894<\/a>.<\/p>\n<p>Since then, voters haven\u2019t been able to choose enough constitutionalist candidates to avoid being stuck with <a href=\"https:\/\/freethepeople.org\/the-deep-state-consists-of-every-progressive\/\" target=\"_blank\">Progressive<\/a> supermajorities, <a href=\"https:\/\/rconstitution.us\/voters-dilemma\/\" target=\"_blank\">election after election<\/a>.<\/p>\n<p>For the right constitutional interpretations to emerge and get selected for by voters requires satisfying two conditions: government people must make changes, and some of the changes must be for the better.<\/p>\n<p>Since 1894, very few candidates have run who would limit governments. When there\u2019s little difference between candidates, the general welfare doesn\u2019t improve much differently under one <a href=\"https:\/\/rconstitution.us\/voters-dilemma\/\" target=\"_blank\">nominal party<\/a> than under the other. Voters just seesaw one party into the majority, then the other. Nothing significant changes.<\/p>\n<p><strong>Doing the Right Thing<\/strong><\/p>\n<p>We\u2019re now in a rare time when an executive has initially been making the right interpretations.<\/p>\n<p>Trump could follow through to make big changes now. <a href=\"https:\/\/freethepeople.org\/freedom-caucus-path-to-constitutionally-limited-governments\/\" target=\"_blank\">State-government people<\/a> could make bigger changes, now or in the future. <a href=\"https:\/\/1drv.ms\/w\/s!An3D-l3nOEaanNwTt84bVzjjvfcdrw?e=s3AcDv\" target=\"_blank\">Other executives<\/a> could make bigger changes in the future.<\/p>\n<p>A judge\u2019s position doesn\u2019t give him any formal <a href=\"https:\/\/founders.archives.gov\/documents\/Hamilton\/01-04-02-0241\" target=\"_blank\">force or will<\/a>, so it might look as if a judge would always be overpowered by the political branches unless they would always defer to him. But in practice, people behave differently than that. Swing politicians, in particular, don\u2019t commit early. Judges, in contrast, do lead with their opinions; so judges naturally marshal considerable political power. A judge\u2019s opinion can shape public opinion, persuading swing voters over to his side, in turn pushing politicians to get onboard.<\/p>\n<p>Government people, in all jurisdictions and branches, are people. People make <a href=\"https:\/\/rconstitution.us\/high-reliability-self-governance\/\" target=\"_blank\">errors<\/a>, some of them <a href=\"https:\/\/mises.org\/power-market\/progressives-automaticity-kills-and-kills-and-kills\" target=\"_blank\">deadly serious<\/a>.<\/p>\n<p>It would be tyrannical to give any officials the final word.<\/p>\n<p>Change favors freedom. And as illustrated earlier, freedom always works out for the best, soon enough. If a change is for the better from the start, it creates new winners who make the change stay around for a while. If a change is for the worse initially, it causes pushback that brings change <a href=\"https:\/\/rconstitution.us\/changing-government-by-stepping-phasing-or-doing\/\" target=\"_blank\">for the better<\/a>.<\/p>\n<p>The right constitutional interpretation is always the one that most-severely limits governments. For the right interpretation to emerge, someone must make this interpretation, and he must stand firm.<\/p>\n<p>Presidents have strong powers to protect the Constitution by not taking any action that they themselves <a href=\"https:\/\/rconstitution.us\/on-the-reading-of-old-constitutions\/\" target=\"_blank\">interpret<\/a> to be <a href=\"https:\/\/freethepeople.org\/separate-powers-automatically-using-simple-rules\/\" target=\"_blank\">unconstitutional<\/a>. Every president can make America freer, and Americans will take it from there and make America <a href=\"https:\/\/mises.org\/mises-wire\/genuine-recovery-investors-producers-and-consumer-choice\" target=\"_blank\">great<\/a>.<\/p>\n<p>Trump can make America freer, right now.
